Welcome to Radar Parts. These Terms of Use (the "Terms") explain the rules that apply when you access or use Radarparts.com and any related pages, tools, forms, communications, marketplace features, and services made available by Radar Parts ("Radar Parts," "we," "us," or "our").
By accessing or using the Site, submitting a parts request, browsing Marketplace Leads, placing an order, or otherwise using the Site or services, you agree to be bound by these Terms. If you do not agree, do not use the Site.
Marketplace Role and Nature of Service
Radar Parts operates an online marketplace and sourcing platform for used automotive parts. Radar Parts helps connect buyers seeking used automotive parts with third-party sellers, recyclers, dismantlers, salvage yards, suppliers, and other independent sources (each, a "Seller").
Radar Parts may receive part requests from buyers, locate potential Sellers, present quotes, listings, or sourcing results, facilitate checkout on the Site, collect payment, administer refunds or credits in accordance with these Terms or applicable transaction policies, and coordinate communications relating to fulfillment.
Radar Parts does not manufacture, stock, warehouse, refurbish, or physically inspect parts unless expressly stated in a separate signed writing. Radar Parts may use software tools, photographs, videos, descriptions, grading inputs, AI-assisted image analysis, Automotive Recyclers Association (ARA) scoring references, and third-party data to help evaluate or categorize cosmetic condition, but such tools and references are informational only and do not constitute a physical inspection, certification, or warranty by Radar Parts.
Unless Radar Parts expressly states otherwise in a separate signed writing, Radar Parts is not intended to take title to the parts sold through the Site, and third-party Sellers remain responsible for the parts they offer, including product descriptions, inventory availability, shipment fulfillment, legality of sale, and any Seller-provided warranty.
Radar Parts may display parts or sourcing results in response to a buyer request and may also in the future allow Sellers to link, upload, sync, or publish inventory directly to the Site. Whether a part is sourced in response to a buyer request or displayed from Seller-linked inventory, these Terms apply unless superseded by transaction-specific terms presented at checkout.
Eligibility and Authority
You represent and warrant that:
- you are at least 18 years old;
- you have the legal capacity to enter into these Terms;
- if you use the Site on behalf of a company, shop, insurer, fleet, or other entity, you have authority to bind that entity; and
- all information you provide is truthful, current, and complete.
Scope of Services
Radar Parts may provide one or more of the following services:
- receiving buyer requests for used automotive parts;
- searching for and identifying potential part sources;
- obtaining and relaying quotes, availability, mileage, grade, condition descriptions, photos, VIN compatibility information, and shipping estimates from Sellers;
- displaying Marketplace Leads, quote responses, or Seller-linked inventory on the Site;
- facilitating order checkout, payment processing, communications, and logistics support; and
- administering returns, refunds, credits, or claim workflows in accordance with Radar Parts policies.
Radar Parts does not guarantee that any requested part will be located, available, compatible, accurately described, timely delivered, or fit for a particular purpose.
Marketplace Leads and Listings
The Site may display part opportunities, quote responses, listings, sourcing matches, inventory records, or other marketplace leads generated by Radar Parts, Sellers, data providers, or automated systems (collectively, "Marketplace Leads"). Marketplace Leads may be displayed in response to a buyer request or from Seller-linked, uploaded, synced, or otherwise published inventory.
Any Marketplace Lead, listing, match, quote response, inventory indication, condition notation, image, or availability signal shown on the Site is informational only and may be changed, corrected, withdrawn, or become unavailable at any time without notice. Radar Parts does not guarantee that any Marketplace Lead is complete, current, available, error-free, or suitable for the buyer's intended use.
Radar Parts may sort, rank, filter, score, label, or prioritize Marketplace Leads using business rules, seller inputs, availability signals, logistics estimates, commercial factors, automated tools, AI-assisted analysis, ARA-related references, or other criteria in its discretion. Such ranking or presentation does not constitute a warranty, endorsement, certification, or representation by Radar Parts regarding the part or Seller.
Quotes, Availability, and Information Accuracy
Any quote, listing, lead, match, description, image, interchange reference, mileage statement, grade, OEM reference, inventory indication, ETA, or shipping estimate made available through the Site is provided for convenience only and is based on information received from third parties or automated systems.
Such information:
- may change without notice;
- may contain delays, omissions, mismatches, or errors;
- is not a binding offer by Radar Parts unless and until accepted through the checkout process or otherwise confirmed by Radar Parts; and
- does not constitute a representation or warranty by Radar Parts.
A part is not reserved until the applicable order is accepted and payment is successfully processed.
Buyer Responsibility for Fitment and Suitability
The buyer is solely responsible for verifying that any part is correct and suitable for the intended vehicle and use before purchase, installation, or resale.
This includes verifying, where applicable:
- year, make, model, trim, submodel, engine, drivetrain, transmission, and production date;
- VIN match and interchange compatibility;
- OEM or manufacturer part number;
- emissions, calibration, programming, coding, and module requirements;
- color, finish, dimensions, mounting points, connectors, and options;
- mileage, grade, condition, and rebuild/refurbishment status; and
- compliance with applicable laws, regulations, insurer requirements, and repair standards.
Radar Parts is not responsible for fitment errors, coding issues, labor costs, teardown or reinstallation costs, diagnostic time, paint or prep costs, shipping delays, loss of use, or any other indirect or downstream cost arising from an incorrect, delayed, defective, or nonconforming part.
Payment Collection and Remittance
Radar Parts may collect payment from buyers before remitting amounts to Sellers. In doing so, Radar Parts acts as the customer-facing marketplace and transaction administrator for orders placed through the Site.
By submitting an order through the Site, you authorize Radar Parts and its third-party payment processors, including Stripe or similar providers, to charge your selected payment method for all amounts due in connection with the order, including the part price, shipping charges, taxes, fees, core charges, surcharges, and other disclosed amounts.
Unless otherwise stated in writing:
- all fees and prices are stated in U.S. dollars;
- the price shown at checkout is the full amount the buyer will pay for the order, except for any amounts separately disclosed before checkout;
- Radar Parts may collect payment from the buyer, hold funds, split funds, remit net proceeds to Sellers, and deduct fees, refunds, credits, chargebacks, taxes, processing costs, shipping adjustments, or other lawful offsets;
- fees paid to Radar Parts for sourcing or brokerage services are non-refundable once Radar Parts has materially performed the applicable sourcing work, except as required by law or expressly stated in a transaction-specific policy; and
- payment obligations are non-cancelable except as required by law or expressly stated in writing.
Payment collection by Radar Parts does not, by itself, mean that Radar Parts manufactures, owns, inspects, warehouses, refurbishes, or independently warrants the part, unless Radar Parts expressly states otherwise in a separate signed writing.
Radar Parts may use third-party payment processors. Radar Parts is not responsible for the acts or omissions of payment processors, except to the extent required by law.
Marketplace Role; No Title Transfer; No Seller Obligations Assumed
Unless Radar Parts expressly states otherwise in a separate signed agreement:
- Radar Parts operates the Site as a marketplace operator, sourcing platform, and transaction administrator;
- Radar Parts may facilitate checkout, collect payment, issue receipts, and remit amounts to Sellers, less applicable fees, refunds, chargebacks, credits, taxes, and other lawful offsets;
- Radar Parts is not intended to take title to any part;
- title to the part passes, if at all, directly from the applicable Seller to the buyer under the applicable Seller terms or transaction-specific terms;
- Radar Parts is not the manufacturer, rebuilder, installer, warehouseman, refurbisher, or physical inspector of any part;
- Radar Parts does not assume the Seller's obligations regarding product quality, conformity, legality, fulfillment, shipping performance, returns, refunds, core charges, or taxes solely by facilitating the marketplace transaction or collecting payment; and
- Radar Parts is not responsible for a Seller's acts, omissions, insolvency, misconduct, or failure to perform.
Any title transfer, risk of loss, shipping terms, Seller warranties, return rights, and refund rights for parts are determined by these Terms, any transaction-specific terms presented by Radar Parts, the applicable Seller's terms to the extent incorporated, shipping carrier terms, and applicable law.
Returns, Refunds, Shipping, and Core Charges
Radar Parts seeks to provide buyers with a consistent transaction experience. Accordingly, Radar Parts may establish marketplace-wide policies and procedures regarding cancellations, returns, inspections, refunds, credits, core charges, freight claims, damage reporting, and claim submission deadlines.
Unless otherwise stated in a transaction-specific policy at checkout or in an order confirmation, and except as required by applicable law:
- the buyer must notify Radar Parts of any return request, wrong-part claim, shipping damage claim, or material not-as-described issue within seven (7) days after delivery;
- any approved returned part must be received at the designated return location within twenty-one (21) days after delivery, unless Radar Parts provides different written instructions;
- returned parts must be in substantially the same condition as delivered, subject to reasonable inspection handling;
- buyers must follow all return authorization, packaging, freight, and documentation instructions provided by Radar Parts or the Seller; and
- labor costs, installation costs, removal costs, diagnostic costs, programming or coding costs, paint or preparation costs, towing, storage, loss-of-use damages, and similar expenses are excluded and will not be reimbursed by Radar Parts unless expressly stated otherwise in writing.
Parts sourced through Radar Parts may also be subject to the applicable Seller's separate terms, including policies regarding: returns and restocking; inspection windows; damage reporting deadlines; core charges and core return procedures; freight claims; cancellation fees; warranty limitations; and exclusions for labor, consequential damages, electrical components, modified parts, or improper installation.
To the extent permitted by law, Radar Parts may decide whether a buyer claim will be handled through a refund, credit, replacement coordination, return authorization, denial, or other resolution, subject to any remedies required by applicable law. Radar Parts may request photographs, diagnostic records, shipping documentation, installation information, or other supporting materials.
You must comply with all claim windows, return instructions, freight inspection requirements, and core return requirements communicated by Radar Parts or the Seller. Failure to do so may result in denial or reduction of a claim.
Seller Warranties Only; No Warranties by Radar Parts
RADAR PARTS DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, OR THAT A PART WILL MATCH ANY DESCRIPTION OR BE AVAILABLE, DELIVERED, ROADWORTHY, REPAIRABLE, INSURABLE, OR FREE OF DEFECTS.
WITHOUT LIMITING THE FOREGOING, RADAR PARTS DOES NOT WARRANT: the existence, quality, condition, legality, safety, or authenticity of any part; the accuracy of Seller-provided information, third-party listings, or automated or AI-assisted condition analysis; that any part will satisfy OEM standards, insurer standards, repair program requirements, ARA grading expectations, or local law; that any cosmetic analysis, image review, grading notation, or automated assessment is complete or error-free; that any Seller will perform as promised; or that the Site will be uninterrupted, secure, or error-free.
Any warranty for a part, if any, is solely that of the applicable Seller or manufacturer and not Radar Parts. If Radar Parts communicates a Seller-provided warranty, Radar Parts is passing through that warranty information for convenience only and is not independently adopting or expanding it.
Taxes
Radar Parts may calculate, collect, and remit sales tax and similar indirect taxes where Radar Parts determines collection is required or appropriate. Amounts charged may include estimated taxes based on information available at checkout. Buyers remain responsible for any taxes, duties, or other governmental charges not collected at checkout, to the extent applicable.
User Conduct
You agree not to:
- use the Site for any unlawful, fraudulent, deceptive, or abusive purpose;
- submit false, inaccurate, or misleading vehicle or order information;
- interfere with or disrupt the Site or its security;
- scrape, crawl, copy, reverse engineer, or use automated means to access the Site or Site content except as expressly authorized by Radar Parts in writing;
- upload malicious code or attempt unauthorized access;
- circumvent fees, sourcing workflows, or technical restrictions;
- use the Site to infringe intellectual property or privacy rights; or
- misuse any quote, Seller data, or contact information obtained through the Site.
Accounts and Communications
If Radar Parts provides account access, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
By providing your email address or phone number, you consent to receive transactional communications from Radar Parts, including by email, call, or text message, relating to quotes, order updates, shipping, payment, returns, and support. These communications may be made or sent by Radar Parts or its service providers using automated technology, AI-generated or artificial voice technology, prerecorded voice messages, or automated text messaging technology, to the extent permitted by applicable law and based on any consent required by applicable law.
You are responsible for any carrier charges. Consent to transactional texts or calls is not a condition of purchase where prohibited by law. Marketing communications, if any, will be governed by applicable law and applicable consent and opt-out rights.
Intellectual Property
The Site, including its text, graphics, branding, software, workflows, compilations, databases, design, and other content, is owned by or licensed to Radar Parts and is protected by intellectual property laws.
Subject to these Terms, Radar Parts grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your internal business or personal use in connection with legitimate parts sourcing.
Except as expressly allowed by Radar Parts in writing, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, transmit, sell, license, or exploit the Site or Site content.
Feedback
If you provide suggestions, ideas, feature requests, or other feedback, Radar Parts may use them without restriction or compensation to you.
Third-Party Services and Links
The Site may integrate with or link to third-party websites, marketplaces, recyclers, payment processors, carriers, data providers, SMS providers, analytics providers, or other services. Radar Parts does not control and is not responsible for third-party services, content, or policies.
Your use of third-party services is governed by their own terms and policies.
Privacy
Your use of the Site is also subject to the Radar Parts Privacy Policy, which is incorporated into these Terms by reference.
Indemnification
You agree to defend, indemnify, and hold harmless Radar Parts and its affiliates, owners, officers, directors, employees, contractors, agents, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- your use of the Site;
- your breach of these Terms;
- your violation of law;
- information you submit;
- your dispute with a Seller, carrier, installer, insurer, or customer; or
- your installation, resale, or use of any sourced part.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADAR PARTS' AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE, SERVICES, OR ANY TRANSACTION PROCESSED THROUGH THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU DIRECTLY TO RADAR PARTS FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Nothing in these Terms limits a buyer's entitlement to any refund, credit, or remedy that Radar Parts expressly provides in a transaction-specific return, refund, or order policy, but no such policy creates any product warranty by Radar Parts.
Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some of the above may not apply to you.
Release; Disputes With Sellers
To the maximum extent permitted by law, you release Radar Parts from claims, demands, and damages arising out of or related to disputes between you and any Seller, carrier, installer, repair facility, insurer, or other third party, including disputes relating to part condition, title, authenticity, quality, delivery, delay, returns, refunds, core charges, warranties, fraud, misrepresentation, negligence, or nonperformance.
Radar Parts may administer claims, returns, refunds, credits, or other dispute-resolution steps under Radar Parts marketplace policies, but Radar Parts has no obligation to provide any remedy beyond what is expressly stated in these Terms, applicable order terms, or required by law.
Suspension and Termination
Radar Parts may suspend or terminate your access to the Site at any time, with or without notice, if Radar Parts believes you have violated these Terms, pose a risk, or for any other lawful business reason.
Sections that by their nature should survive termination will survive, including provisions concerning disclaimers, limitations of liability, indemnification, dispute resolution, intellectual property, payments, and general terms.
Electronic Records
You agree that Radar Parts may provide notices, disclosures, and records electronically, and that electronic agreements and records satisfy legal writing requirements to the extent permitted by law.
Dispute Resolution; Arbitration; Class Action Waiver; Jury Waiver
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the services, or any transaction processed through the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable commercial arbitration rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
The arbitration shall take place in Union County, New Jersey, unless the parties agree otherwise.
Notwithstanding the foregoing, Radar Parts may seek temporary, preliminary, or permanent injunctive relief, or other equitable relief, in any state or federal court of competent jurisdiction located in New Jersey to protect its intellectual property, confidential information, platform security, or other proprietary rights.
To the extent any dispute is permitted to proceed in court rather than arbitration, the parties agree to exclusive venue in the United States District Court for the District of New Jersey, Newark Vicinage, or, if federal jurisdiction is unavailable, the state courts located in Union County, New Jersey.
To the maximum extent permitted by law, all disputes shall be resolved only on an individual basis and not on a class, collective, consolidated, private attorney general, or representative basis. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party's individual claim. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
To the fullest extent permitted by law, each party knowingly and voluntarily waives any right to a trial by jury in any proceeding arising out of or relating to these Terms, the Site, the services, or any transaction processed through the Site.
Each party waives any objection based on forum non conveniens or improper venue to the fullest extent permitted by law.
Changes to Terms
Radar Parts may update these Terms from time to time by posting a revised version on the Site. The updated Terms will be effective as of the "Last Updated" date unless otherwise stated. Your continued use of the Site after updated Terms are posted constitutes acceptance of the updated Terms.
General Terms
These Terms constitute the entire agreement between you and Radar Parts regarding the Site and supersede prior or contemporaneous understandings on that subject, except for any separate written agreement signed by Radar Parts.
If any provision is held unenforceable, the remaining provisions will remain in full force and effect. Radar Parts' failure to enforce any provision is not a waiver.
You may not assign these Terms without Radar Parts' prior written consent. Radar Parts may assign these Terms in connection with a merger, sale, reorganization, or transfer of assets.
